Education License

The Ministry of Education has established the following requirements and conditions for opening up a school (e.g. English language school):

  • The building must be independent from other businesses and have a fire exit or a fire protection measure of the school
  • The building must be permitted to be used “for education”
  • Area:
    • If the course is shorter than six months and less than 600 hours, it must have the operating area not less than 100 square meters
    • If the course is longer than six months or not longer than one year and not less than 1200 hours, it must have the operating area not less than 200 square meters
  • Study room must have the area not less than 20 sq. m. provided that it has the width not less than 3.5 m
  • The toilet must be separated for Gentleman and Lady and enough for number of students (35 students for one rest room and another one rest room for every 20 students).
  • The Licensee must own the building or have the lease for the term not less than three years from the date of submission. The lease agreement must specify the purpose of the lease, specifically for using it as a school.

An Education License is required to operate a school in Thailand.

The Licensee must have all personnel ready for every position particularly the licensee (owner), the executive (principal), including teacher/lecturer in every subject along with the staff members who are necessary to operate the school.

Licensee (owner)
  • Person
    • Thai Nationality
    • Age not less than 20 years old
    • Bachelor Degree or higher
    • Good behavior
    • Honor of democratic form of government with the King as Head of State
    • Not being bankrupt
    • Never having been fired from a government servant position due to being found guilty in a criminal case
    • Never had a school license that had been cancelled before
    • Not having been adjudged as an incompetent person or quasi-incompetent
    • Never been put in prison or if acquitted, then not less than five years previously
  • Company
    • The company objective must be for education. If the registered address of the company is the school address, then the company must have only one objective, which is for education. No other objectives are allowed.
    • Having enough capital for school operation (amount at official’s discretion)
    • Thai major shareholders (both by number of shares and by number of shareholders)
    • Only one Thai director and having the qualification as an individual applicant
Executive (principal)
  • Thai Nationality
  • Age not less than 20 years old
  • Bachelor Degree or higher and have work experience in a related field or have teaching experience of not less than one year
  • Not having any of the prohibited diseases
  • Good behavior
  • Not being bankrupt
  • Never having been fired from a government servant position due to being found guilty in a criminal case
  • Never been put in prison or if acquitted, then not less than two years previously

The applicant must prepare the letter to give the details of the Executive’s profiles and attach the documents such as a copy of educational certificates, a copy of their house registration book, a copy of their ID card, a copy of the employment agreement, medical certificate, and a letter to certify the work experience from previous employer.

Teacher

Must have a teacher qualification license and does not contain the prohibited attributes for a professional teacher under the laws of Teacher Council and educational personnel.

Lecturer
  • Age not less than 18 years old
  • Have knowledge as required by the rules
  • Good behavior
  • Not having been adjudged as an incompetent person or quasi-incompetent
  • Never been fired from a government servant position due to being found guilty in a criminal case
  • Never put in prison or if acquitted, then not less than two years previously

  •  Letter of appointment

  •  Employment contract
    • 

  •  Copy of bachelor’s degree or graduate degree

  •  Certification letter showing work experience in the field for at least one year in Thailand
    • 
  
  •  Employer letter of the institute of previous employment
    • 
  
  •  Copy of Thai ID card
    • 
  
  •  House registration
    • 
  
  • Medical certificate  issue within the past one month
    • 
  
  •  Three recent photographs taken within the last six months
